If you deliver the goods yourself, you need to be prepared for the fact that during delivery you will have to bear responsibility for all mechanical defects (breakdowns, chips, cracks, etc.) that may appear on the way from the store to the apartment.
However, a lot of problems arise when the delivery is carried out by the corresponding service service of the store. Often, drivers who deliver a purchase demand money for this service. The astonished owner has to pay without receiving any documents in return.
And if the delivery is still accompanied by the signing of the act, it often happens in such a hurry that the buyer does not have time to inspect the goods. When it turns out that during transportation the new washing machine was shaken, the body bent, the belt flew off the drum or the ditch cracked, the question arises: what to do?
Relations on the delivery of goods are regulated by Chapter 40 of the Civil Code of the Russian Federation. Article 796 establishes the carrier's liability for loss, shortage and damage (damage) of cargo or baggage. It provides that the carrier is responsible for the non-safety of the cargo that occurred after its acceptance for carriage and before delivery to the consignee, unless it proves that the loss or damage occurred for reasons that the carrier could not have foreseen and the elimination of which did not depend on him.
The damage caused is compensated by the carrier in the amount of the amount by which the value of the goods has decreased, and if it is impossible to restore the damaged cargo in the amount of its value. In addition to the actual damage, the carrier is obliged to return to the recipient the amount collected for the carriage of the cargo, if it is not included in its cost.
In order not to get into such situations, you need to remember and follow a few simple rules:
- when making out and paying for delivery in the store, do not sign an invoice for the goods that have not yet been delivered in advance;
- after accepting the delivered goods, do not rush to sign for receipt until you carefully inspect it for visible mechanical damage. If you find them, you can safely send the item to the store and demand another one in return.
